Sample Notice of Termination for Falsification of Commercial Documents
This is the final notice of the offense Falsification of Other Commercial Documents which in my previous post I shared the sample Notice to Explain. These two notices are crucial in making sure that the dismissal of employee complies with the procedural due process requirements.
This is based on my book HR Forms, Notices & Contracts Volume 2 pp 24-25. Don’t labor thinking how to create the legally defensible notices of disciplinary action. This book will help you and you can copy the templates. 
Form No. 7 Decision to Dismiss (Final Notice) – Falsification of other commercial documents

From : HR MANAGER or other authorized officer
Subject : Falsification of other commercial documents
Date : (Date of issuance)
This refers to our show cause memo on the subject matter dated _______________.
Our records reveal the following facts:
It appears from the records of the Finance Department that certain commercial documents, particularly the ________ (e.g. Cash book), contain false entries, to the disadvantage of the Company. In response to our show cause memo, you submitted your written explanation on ______________.
In the same explanation, we note that _____________________ (if any admission is made, state it here). During the scheduled conference on ______________, you were given the opportunity to explain or defend your side on the matter. (State any detail during the conference that may bolster the belief that a violation was committed) (State other details to substantiate charge, refute statement of employee if applicable, and complete justification for the company’s decision.)
In this connection, falsification of other commercial documents constitutes fraud which is a ground for termination of employment under the Labor Code. After a thorough review and discussion on the matter, we find that your act of falsifying other commercial documents such as ____________ was deliberate, unjustified and fraudulent.
As an employee clothed with responsibilities of keeping financial records of the Company, your falsification of other commercial documents has resulted in our loss of confidence in you, which is essential in maintaining a position such as yours.
In view of the foregoing, you are hereby informed that your employment with the Company is terminated effective on the closing hours of _______________ (date). Please comply with the relevant post-employment requirement of the Company by surrendering your accountabilities to _________________ (department or officer) for the Company to process your final salary.
