Personal Protective Equipment (PPE) shall be provided to workers in accordance with safety regulations free of charge.

Under D.O. 13, Series of 1998, every employer shall, at his own expense, furnish his workers with protective equipment for eyes, face, hands and feet, lifeline, safety belt/harness, protective shields and barriers whenever necessary by reason of the hazardous work process or environment, chemical or radiological or other mechanical irritants or hazards capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical agent.

Provision of personal protective equipment (PPE) shall be in accordance with Rule 1080 of the OSHS. The equivalent cost for the provision of PPE (life span, depreciation, replacement, etc.) shall be an integral part of the project cost.

The employer shall provide adequate and approved type of protective equipment. Workers within the construction project site shall be required to wear the necessary PPE at all times.

Construction workers who are working from unguarded surfaces six (6) meters or more above water or ground, temporary or permanent floor platform, scaffold or where they are exposed to the possibility of falls hazardous to life or limb, must be provided with safety harnesses and life lines.

Specialty construction workers must be provided with special protective equipment, such as specialized goggles or respirators for welders and painters or paint applicators. All other persons who are either authorized or allowed to be at a construction site shall wear appropriate PPE.

However, there are burning questions with respect to the cost of the PPE. While it is reasonable to allow the assignment without cost to the employees, it cannot be abused. Simply because the PPE should be free of charge does not mean that employees have to disregard the proper use of the company property.

The PPE remains to be the property of the company and the workers are just allowed to use without cost on their part. But if the same are lost, destroyed, stolen, etc. due to the fault or negligence of the employee, it only makes sense to require workers to pay for replacement.Human Resource Forms Contract and Notices by Atty Elvin B Villanueva

Below here is a sample acknowledgment of receipt of PPE with Filipino translation since most workers who need the PPE are not conversant or proficient of the English language. The form below is just illustrative in nature and does not ensure fitness to any situation or application for legal resolution.

ACKNOWLEDGMENT OF PERSONAL PROTECTIVE EQUIPMENT (PPE)AND ITS POLICIES, TERMS AND CONDITIONS

I __________________________________, hereby acknowledge that I have received in good working condition the following assigned PPE, free of charge, from COMPANY, as follows:

(Ako si, _______________________________, ay nagpapatunay na natanggap sa maayos na kondisyon at nagagamit ang mga sumusunod na PPE na walang binayaran sa COMPANY o hindi siningil ng anumang halaga):

  1. Hard hat
  2. Steel-toed shoes
  3. Protective eye wear / goggles
  4. ____________________

I understand that while they were issued and assigned for free, they remain the exclusive property of COMPANY. While I am free to use them for official duties, I am not allowed to use them for personal reason.

  1. The PPEs shall be worn at all times in accordance with the policies, rules, and regulations of the company and government agency.

(Ang PPE ay dapat na isuot sa lahat ng pagkakataon na ito ay kailangan o ipinag-uutos ng batas, polisiya, regulasyon, at patakaran ng kompanya at ng pamahalaan)

  1. The PPEs shall be used only by me and shall not be assigned for use by any third person/party. If the PPEs issued to me are found in the possession other people it shall be understood that I assigned them in violation of the policies being without COMPANY consent and authority.

(Ang mga nasabing PPE ay ako lamang ang gagamit at hindi ito ipapagamit kanino man. Kung ang nasabing PPE na ipinagamit sa akin ay makitang ginagamit o suot ng ibang tao ito ay nangangahulugan na aking ipinasa at ipinagamit ng labag sa regulasyon at patakaran ng kompanya dahil ito ay walang pahintulot ng pamunuan)

  1. The PPEs shall be returned to their respective areas in the office, workshite or place of project/barracks and shall not be taken home at any time.

(Ang mga PPE ay aking ibabalik sa takdang lugar pagkatapos ng trabaho sa loob man ng opisina, worksite, barracks, o project site at ito ay hindi ko i-uuwi o dadalhin sa labas ng nasabing lugar.)

  1. If the PPEs shall be lost, destroyed, damaged, or rendered unusable, I undertake to pay for the replacement and authorize the company to withhold any amount from any sum due me pending payment of said PPEs.

(Kung sakaling ang mga PPE ay mawala, masira, o hindi na magagamit dahil sa aking kapabayaan o pag-gamit, babayaran ko ang bibilhing kapalit ng mga ito. Binibigyan ko ng kapangyarihan ang kompanya na hindi muna ibigay sa akin ang anumang halaga na para sa akin hangga’t hindi ko nababayaran ang kapalit na mga PPEs)

  1. I will follow the existing policies and procedures on the use of the PPEs and any subsequent amendments thereto.

(Nangangako akong susunod sa mga alituntunin, patakaran, at regulasyon ng pag-gamit ng mga PPE at sa mga pagbabagong gagawin dito, susog, o amendments)

  1. If I resign or is separated from work, for whatever reason, I undertake to return in full the said PPEs and pay for any replacement for those damaged ones as mentioned herein.

(Kung sakaling ako ay umalis sa trabaho o tinanggal sa anumang kadahilanan, ibabalik ko ang mga PPEs ng buo at magbabayad ng para sa kapalit ng mga nasira, nawala, o hindi na magamit ayon sa nabanggit dito)
