Notice To Explain Theft With Preventive Suspension (Filipino/Tagalog)
Notice to Explain (NTE) for theft is shown here to guide HR Practitioners, owners and business managers of the procedural due process requirements involving cases of theft inside the company premises.
The Revised Penal Code generally defines theft as an act committed by any person who, with intent to gain but without violence against or intimidation of persons nor force upon things, shall take personal property of another without the latter’s consent. (page 124, Guide to Valid Dismissal of Employees Second Edition)
An employee was held to be validly dismissed for the loss and unauthorized sale of the company’s electric copper wire cable upon findings that he sold the same and shared the proceeds with his three co-employees. (Asian Terminals, Inc., Petitioner, vs. Sallao, G.R. No. 166211, July 14, 2008 cited in the book Guide to Valid Dismissal of Employees Second Edition)
The employer has two options in case of theft case:
- Issue the NTE without preventive suspension
- Issue the NTE with preventive suspension
The rationale behind the issuance of preventive suspension is to prevent further commission of the act, tampering of evidence, or harassment of witnesses during the investigation process.
The Implementing Rules provides that (See discussion in the above book):
“Sec. 3. Preventive suspension.—The employer can place the worker concerned under preventive suspension if his continued employment poses a serious and imminent threat to the life or property of the employer or of his co-workers.

Sec. 4. Period of suspension.—No preventive suspension shall last longer than 30 days. The employer shall thereafter reinstate the worker in his former or in a substantially equivalent position or the employer may extend the period of suspension provided that during the period of extension, he pays the wages and other benefits due to the workers. In such case, the worker shall not be bound to reimburse the amount paid to him during the extension if the employer decides, after completion of the hearing, to dismiss the worker.”

Subject: NTE with Preventive Suspension
Ito ay may kinalaman sa ulat na natanggap ng kompanya tungkol sa diumano pagkuha ng kable ng kuryente mula sa bodega.
Napag-alaman na noong January _____, 2019, ikaw ay nakita sa CCTV na pumasok sa bodega na may dalang knapsack na tila walang laman. Paglabas mo makikita na ang nasabing knapsack bag ay nakabukol at mukhang puno na parang mayroon ng laman.
Makikita rin na hindi ka dumaan sa harapang gate na kung saan may guwardiya na dala ang nasabing bag. Makikita sa CCTV sa likod ng opisina na may hinagis kang sako patawid ng pader sa may kalsada.
Noong nag-imbentaryo ng mga kable, napag-alamang may kulang na sampung metro. Noong tinanong ka ng guwardiya kinabukasan kung ano ang sakong itinapon mo sa may kalsada binanggit mo na basura iyon.
Dahil sa nangyari, ikaw ay mag sumite ng nakasulat na paliwanag hinggil sa nangyari sa loob ng limang (5) araw (calendar days) mula nang matanggap ang NTE na ito. Ipaliwanag mo kung bakit ikaw ay hindi isailalim sa disciplinary policy ng kompanya na maaring maging dahilan ng pagkatanggal sa trabaho kung mapatunayan.
Habang nag-iimbestiga, ikaw ay isinasa-ilalim sa preventive suspension sa loob ng tatlumpong (30) araw simula ngayon dahil sa ang nasabing pangyayari ay makakapagdulot ng seryoso at klarong panganib sa mga pag-aari ng kompanya.
Kung ikaw ay hindi makapagsumite ng iyong paliwanag ito ay ituturing na pagtalikod sa iyong karapatan sa nasabing imbestigasyon. Para sa iyong mahigpit na pagsunod.
