Notice to Explain Sample For AWOL (in Filipino/Tagalog)
Notice to Explain or NTE with directive to report to work should be issued to an employee who fails to report for work on the first day of absence without proper notification. This is the best practice for employers who want to be vigilant and uphold the policy.

The advantages of immediately issuing the NTE for AWOL are:
- It affords the company a good defense in case the absence was due to the filing of an illegal dismissal case
- It sends a proper message to the employees that the company is enforcing the policy
- It instills discipline among the ranks
The following may be the disadvantages:
- The employer may be deemed as inconsiderate
- The management may be deemed as callous
No matter the disadvantages though, the office is a professional environment and employees are expected to behave in the same manner. The point of the NTE also is to give the employee a chance to explain the incident and this is where justifications could be made if indeed the absence is justified.
For going AWOL, the employee may be subjected to disciplinary action. (page 171, Guide to Valid Dismissal of Employees, 2nd Edition by Atty. Elvin B. Villanueva citing Metro Transit Organization, Inc. vs. NLRC, G.R. No. 119724, May 31, 1999.)
It bears noting that AWOL is different from Abandonment of Work. AWOL is a stage that may lead to abandonment. Before the employee can be deemed to have abandoned his work he must first commit unjustified absence which is known as AWOL.
When notices (ideally two NTEs for AWOL for the same incident to afford ample due process) sent are ignored despite receipt by employee, abandonment of work may set in.
Abandonment is a form of neglect of duty; hence, a just cause for termination of employment under Article 282 (now Art. 297 in a Re-numbered Labor Code) of the Labor Code. (Page 156, Guide to Valid Dismissal of Employees, 2nd Edition citing Forever Security & General Services vs. Flores, G.R. No. 147961, September 7, 2007)
To constitute abandonment, however, there must be a clear and deliberate intent to discontinue one’s employment without any intention of returning. (Tan Brothers Corporation of Basilan City vs. Escudero, G.R. No. 188711, July 3, 2013)
Two (2) elements must concur: (Northwest Tourism Corp. vs. Former Special Third Division of the Honorable Court of Appeals, G.R. No. 150591, June 27, 2005)
- The employee must have failed to report for work or must have been absent without valid or justifiable reason; and
- There must have been a clear intention on the part of the employee to sever the employer- employee relationship manifested by some overt act.

Ang NTE na ito ay isang paunawa para magpaliwanag sa nakalap na impormasyon ng pamunuan hinggil sa iyong pagliban nang walang paalam.
Ayon sa talaan ng kompanya, noong ____________________, ikaw ay hindi pumasok sa trabaho. Siniyasat sa iyong departamento kung ikaw ay nagsumite ng leave form ngunit walang nakita roon.
Itinanong din sa iyong boss kung ikaw ay tumawag o nag-text na ikaw ay hindi papasok sa trabaho ngunit wala rin daw ganoong impormasyon.
Ayon sa patakaran ng kompanya, kapag liliban sa trabaho dapat magsumite ng leave form (kung Vacation Leave) dalawang araw bago mag-absent. Kung ang dahilan naman ay sakit o anumang sakuna dapat na tumawag sa opisina o mag-text bago mag-alas dose ng tanghali sa unang araw ng pagliban.
Sa iyong kaso, wala ni isa sa mga nabanggit ang naibigay sa opision. Kung kaya, ikaw ay hinihingan ng nakasulat na paliwanag kung bakit hindi dapat disiplinahin sa loob ng limang araw (5 calendar days) mula nang matanggap ang sulat na ito.
