Sample Notices to Explain for Falsification of Attendance Record (in Filipino/Tagalog) with and without Preventive Suspension
Falsification of time cards constitutes serious misconduct and dishonesty or fraud, which are just causes for the termination of employment under Art. 282(a) and (c) of the Labor Code (now Art. 297 in a re-numbered Labor Code; Get a re-numbered copy of Labor Code 2018 here). In one case, the Supreme Court (SC) held that falsifications are crimes punished by the Revised Penal Code itself. Their commission constitutes serious misconduct. (Mirano vs. NLRC, G.R. No. 121112, March 19, 1997)
In another case, the SC held that the falsification and fraud which the employees committed against their employer were inexcusable. The acts constituted dishonesty and serious misconduct, lawful grounds for their dismissal under Art. 282, sub-pars. (a) and (c), of the Labor Code ((now Art. 297 in a re-numbered Labor Code). Ito ay may kinalaman sa insidenteng nakarating sa pamunuan ng kompanya tungkol sa diumano’y pagsumite mo ng Timecard na may hindi tamang mga impormasyon.
Ayon sa ulat, ikaw ay nagsumite ng Timecard para sa panahong _____________ hanggang ___________________ na sakop ng payroll period _________________ o para Katapusang sahod. Napansin na ang mga oras na nakalagay ay may mga sulat-kamay at tila may mga pirma (initials) sa tabi ng mga ito.
Nung una, sinabi mo raw sa HR staff na ang mga binagong oras ay aprubado ng pamunuan ng kompanya na pinatutunayan ng mga pirma (initials). Subalit nung siniyasat sa pamunuan hindi naman daw ito pirmado ng iyong supervisor o kaya department head.
Dahil dito, ikaw ay hinihingan ng nakasulat na paliwanag sa loob ng limang araw (5 calendar days) kung bakit hindi dapat disiplinahin na maaring mag-resulta sa pagka-tanggal sa trabaho dahil sa nangyari.
