Sample Notice of Termination for Falsification of Attendance Record

This is the sample form for termination of employee who committed falsification of his attendance record. In the previous post, the NTE for this offense was already posted. Those following this post may have noticed a wayward topic on “coherence in writing” and “weight loss” which this author did not write.

The IT of this writer is now looking into this incident.

At any rate, the sample notice below is based on the book HR Forms, Notices & Contracts Volume 2, pp. 30-32. This book can help you in all your forms requirements as HR practitioner.

Form No. 11 Decision to Dismiss (Final Notice) – Falsification of attendance sheet

To : Name of Employee

From : HR MANAGER or other authorized officer

Subject : Falsification of attendance sheet

Date : (Date of issuance)

This refers to our show cause memo on the subject matter dated _______________. Our records reveal the following facts:

Our records show that on the following dates, you entered the following times in your attendance sheet: (Date) ________ (time) __________  (Date) ________ (time) __________

The Security guard’s logbook, however, indicate different hours and minutes, which times appear inconsistent with the abovementioned Attendance Sheet entries on the said dates.

In response to our show cause memo, you submitted your written explanation on ______________. In the same explanation, we note that _____________________ (if any admission is made, state it here).

During the scheduled conference on ______________, you were given the opportunity to explain or defend your side on the matter. (State any detail during the conference that may bolster the belief that a violation was committed) (State other details to substantiate charge, refute statement of employee if applicable, and complete justification for the company’s decision.)

In this connection, falsification of entries in your attendance sheet constitutes fraud which is a ground for termination under the Labor Code. After a thorough review and discussion on the matter, we find that your falsification of entries in your attendance sheet was deliberate, malicious and unjustified.

In view of the foregoing, you are hereby informed that your employment with the Company is terminated effective on the closing hours of ___________ (date).

Please comply with the relevant post-employment requirement of the Company by surrendering your accountabilities to _________________ (department or officer) for the Company to process your final salary.
