Notice of Temporary Closure / Suspension of Establishment in Filipino / Tagalog
Notice of temporary closure / suspension of establishment has to be issued to employees affected due to the effects of COVID-19 lockdown.
Suspension of operations, whether full or partial, may be one of the options to resort to for most of the companies in response to the government order placing the entire Luzon under Enhanced Community Quarantine.
The government issued a directive to implement the “Stringent Social Distancing Measures and Further Guidelines for the Management of the Coronavirus Disease 2019 (COVID-19) Situation.” The government further issued Joint Resolution Nos. 11 and 12 (s. 2020) of the Inter-Agency Task Force for the Management of Emerging Infectious Diseases (Task Force) established under Executive Order No. 168 (s. 2014), relative to the recommendations for the management of the COVID-19 situation.
Subsequently, the Executive Secretary of the Office of the President of the Philippines, Malacañang issued a Memorandum dated March 13, 2020. The latest issuance was a Memorandum from the Executive Secretary of the Office of the President of the Philippines, Malacañang dated March 16, 2020 on the Enhanced Community Quarantine all over Luzon.
The government imposed Enhanced Community Quarantine and Stringent social Distancing Measures over the entire Luzon, including national Capital Region (NCR), effective 00:00 (12:00) o’ clock in the morning of March 17, 2020 until 00:00 (12:00) o’ clock in the morning of April 13, 2020.
During this period, only those private establishments providing basic necessities and such activities related to food and medicine production, i.e., public markets, supermarkets, groceries, convenience stores, hospitals, medical clinics, pharmacies and drug store, food preparation and delivery services, water-refilling stations, manufacturing and processing plants of basic food products and medicines, banks, money transfer services, power, energy, water and telecommunications supplies and facilities shall be open.
Hence, companies who are not within such business shall not operate. This is where the suspension of operations come in as among the options of employers.
Bona fide suspension of operations is allowed under Art. 301 of the Labor Code. It states that the bona-fide suspension of the operation of a business or undertaking for a period not exceeding six (6) months, or the fulfillment by the employee of a military or civic duty shall not terminate employment.
The Department of Labor and Employment issued Labor Advisories 9, 11, and 12, Series of 2020 on the utilization of flexible work arrangement or suspension of operations. For most small enterprises, there is no option but to temporarily close or suspend the business.
Below is the sample notice of suspension to employees in Filipino / Tagalog language:

Subject: PANSAMANTALANG PAGSARADO NG KOMPANYA O PAGSUSPINDE NG OPERASYON NITO
Bilang pagsunod sa direktiba ng pamahalaan hinggil sa enhanced community quarantine (a.k.a. lockdown) upang maiwasan ang hawaan ng mga tao ng sakit na COVID-19, nais ipaabot sa inyo ng pamunuan na pansamantalang isarado ang kompanya o itigil ang operasyon hanggang sa matapos ang lockdown.
Ang pamahalaan ay naglabas ng Joint Resolution Nos. 11 and 12 (s. 2020) ng Inter-Agency Task Force for the Management of Emerging Infectious Diseases (Task Force) sa ilalim ng Executive Order No. 168 (s. 2014) hinggil sa COVID-19 na pangyayari. Itinaas ng mga health officials ang Code Alert System para COVID-19 sa buong bansa sa Code Red Sublevel 2, dahil sa mabilis na pagtaas ng bilang ng kumpirmadong kaso ng COVID-19.
Ang Executive Secretary of the Office of the President of the Philippines, Malacañang naglabas ng Memorandum noong March 13, 2020 at nasundan ito ng isa pang Memorandum noong March 16, 2020 na inilalagay sa ilalim ng Enhanced Community Quarantine ang buong Luzon. Sa ilalim nito ang maaring magbukas ng negosyo lamang ay ang mga gumagawa ng mga essential activities gaya ng gamot at pagkain. Ang kompanya ay hindi gumagawa ng mga essential na produkto.
Bilang pagsunod sa mga nasabing kautusan, lalo na ng Social Distancing Measures sa buong Luzon, pansamantalang magsasarado ang kompanya o mag suspinde ng operasyon nito mula 00:00 (12:00) o’ clock ng umaga ng March 17, 2020 hanggang sa 00:00 (12:00) o’ clock ng umaga ng April 13, 2020.
Pinapaalalahanan ang lahat ng mga sumusunod:
- Ang pagsuspinde ng operasyon ay simula 00:00 (12:00) o’ clock ng umaga ng March 17, 2020 hanggang sa 00:00 (12:00) o’ clock ng umaga ng April 13, 2020.
- Sa panahon ng suspension, ang relasyon bilang employer at employee ay suspendido rin, pati ang lahat ng epekto nito. Upang mabawasan ang epekto ng kawalan ng kita, ang mga empleyado ay inaanyayahang gamitin ang kanilang mga leave credits. Kapag ang mga ito ay ubos na, paiiralin na ang no-work, no-pay.
- Ang company, depende sa pangangailangan sa operasyon, ay maaring magtalaga ng mga tungkulin na kwalipikado sa work-from-home. Ang mga empleyadong may hawak ng nasabing posisyon ay babayaran pero kailangan mag-sumite ng accomplishment reports araw-araw.
- Nagpasya ang pamunuan na ipauna (advance) ang bayad sa bahagi ng 13th month pay para sa taong 2020 para sa mga empleyadong naka isang buwan na sa April 13, 2020. Ang pormulang gagamitin ay ang sumusunod:
Pro-rata 13th month pay = Total Basic Salary Earned for the year 2020 / 12
- Ang halaga ng pro-rata na 13th month pay ay ide-deposito sa inyong payroll account sa March 31, 2020. Bilang tulong sa mga empleyado, hindi muna maniningil ng bayad sa mga cash advance o utang sa panahon ng lockdown.
- Ang lahat ng empleyado ay dapat pumasok sa April 13, 2020 ayon sa kanya-kanyang shift schedule at sa patakaran ng kompanya, maliban na lamang kung magbigay ng ibang petsa ng balik-trabaho ang pamahalaan.
- Lahat ng komunikasyon ay dapat ipadaan sa mga online channels gaya ng email, SMS, social media messaging, at iba pa.
- Bilang paalala, dapat ipagpatuloy ang social distancing upang maiwasan ang pagkalat ng COVID-19.
- Bilang paalala, itinakda ng pamahalaan ang istriktong home quarantine sa lahat ng kabahayan. Ang paglabas ng bahay ay kung bibili lamang ng mga payak na pangangailangan (basic necessities) gaya ng pagkain, gamut, at ospital.
