Release, Waiver and Quitclaim Sample Template in Filipino
Release, Waiver and Quitclaim, as a general rule is frowned upon by the court. But it does not mean that it cannot be valid.
The post below is based on the book Guide to Valid Dismissal of Employees (pp. 369-370)
After the employee has separated from work, he may be required, as a matter of policy, to execute release, waiver and quitclaim.
As a general rule, quitclaims executed by employees are often frowned upon as contrary to public policy. But that is not to say that all waivers and quitclaims are invalid as against public policy. (See Suarez vs. National Steel Corporation, G.R. No. 150180, October 17, 2008, 569 SCRA 331.)
It is only where there is clear proof that the waiver was wangled from an unsuspecting or gullible person, or the terms of settlement are unconscionable on its face, that the law will step in to annul the questionable transaction. But where it is shown that the person making the waiver did so voluntarily, with full understanding of what he was doing, and the consideration for the quitclaim is credible and reasonable, the transaction must be recognized as a valid and binding undertaking. Quitclaims will be upheld as valid if the following requisites are present:
- the employee executes a deed of quitclaim voluntarily;
- there is no fraud or deceit on the part of any of the parties;
- the consideration of the quitclaim is credible and reasonable; and,
- the contract is not contrary to law, public order, public policy, morals or good customs or prejudicial to a third person with a right recognized by law.

Ako, si JUAN TU, nasa hustong gulang, Filipino, at nakatira sa _____________________________, pagkatapos manumpa sa ilalim ng batas, ay kusang-loob na naglalahad na):
- Na ako ay naging empleyado ng kompanyag XYZ Corporation bilang isang Mason;
- Noong ________, 20____, ako ay bumitiw (resign) sa aking trabaho ng kusang-loob na walang pananakot, pananakit, panlilinlang o pamimilit.
- Sa panahon ng aking pamamasukan, nakuha at natanggap ko ang lahat ng aking sahod at benepisyo mula sa kompanya. Ang mga nilalaman nito ay sumasakop din sa aking mga kamag-anak at tagapagmana. Kung sakaling ang kompanya ay ihabla na may kinalaman sa Release, Waiver and Quitclaim na ito, ako ay nangangako na depensahan ang kompanya at sasagutin ang anumang gastusin sa demandang nabanggit;
