VARIOUS FORMS OF EMPLOYMENT AND THEIR PECULIAR GROUNDS FOR TERMINATION AS WELL AS GROUNDS COMMON TO ALL
While enforcement of discipline may result in dismissal of employee, not all cases of termination of employment proceed from disciplinary issues.
As a current practice, companies implement different forms of employment such as regular, probationary, casual, fixed-term, seasonal and project. Each of these forms has its unique basis for termination. For instance, a probationary employee may be dismissed for failure to qualify based on the reasonable standards made known to him by the employer at the time of his engagement.
A casual employee may be dismissed if the job for which he was hired ceases to exist or when the term of engagement has expired. Provided, the casual employee has not reached one year of service because by then he becomes a regular employee to the extent of the activities for which he was engaged.
Fixed-term employees may be dismissed upon the expiration of his term. While the project employee may be dismissed upon the completion of the project or a phase thereof. The seasonal worker may be dismissed upon the end of the season.
There is, however, a common ground for which all of these workers may be dismissed. If any of them commits an act inimical to the interests of the employer he may be dismissed regardless of whether the unique ground for his dismissal has materialized.
For instance, a project employee who steals the company’s construction materials may be dismissed for theft or loss of trust and confidence, as the case may be, even though the project is not yet completed.
